Speak to a Lawyer First

Facing criminal charges, especially for the first time, can be an incredibly frightening experience. There may be questions about what happens on your first court date, whether you are going to have a criminal record, or if prison is a possibility. You may have been released under conditions you do not understand or that prevent you from working or even seeing your children. What do you do?

When police question you, do not be afraid to say, “I need to speak to a lawyer.”

If you are not comfortable with a lawyer’s advice, speak with another.

You have a right to silence, and for that silence not to be used against you. Exercise your right!

Are you a suspect? Have you been arrested? Unless you are required to do so by law, stop speaking with police and call a lawyer.

It is okay if you want to tell your side of the story; just do it through your lawyer.

You have a right to speak with a lawyer of your choice; it doesn’t have to be duty counsel. Police have a duty to help you contact that lawyer, even if you have never spoken to that lawyer before.

You have a right to silence. But that doesn’t mean police can’t continue questioning you. If you choose not to cooperate, tell police, repeatedly, “I want to remain silent and to be released or returned to cells” until they comply.
